Open Studio Terms of Use
This document sets out the terms of use that apply to the use of Open Studio at RISE by 101 Collins (RISE), which is on premises that are managed by 101 Collins Street Management (ACN 004 582 423) (101 Collins). These terms of use apply in addition to the RISE Terms and conditions of membership. By signing the consent below, you agree to comply with these terms and conditions on each visit to the Open Studio.
YOUR RESPONSIBILITIES
Accessing the Open Studio
To access the Open Studio, you must use your issued swipe card. Your swipe card must only be used for your individual access, and cannot be shared with anyone else.
You must keep the Open Studio door closed at all times during your visit to the Open Studio
You must only use the Open Studio during pre-booked timeslots you have booked through the RISE app.
You must turn off any fans in the Open Studio you have switched on at the end of your allocated time slot.
Hygiene
You must comply with all rules, policies, procedures and directions issued by 101 Collins or its nominee from time to time about health and hygiene practices. These include (but are not limited to):
wiping down equipment with the antibacterial wipes provided;
washing your hands; and
using a towel at all times.
Use of equipment
Before using any equipment, you must inspect its functionality and condition. You agree to exercise due care when using the equipment and only use equipment you are familiar with and know how to use safely and correctly.
You acknowledge and agree that you have attended all required induction sessions and have received instructions on practising safe gym etiquette and will follow all recommendations discussed in that induction. You must follow those recommendations and instructions, and acknowledge that failing to do so increases the risk of injury to you or damage to equipment. You agree to scan the QR code provided in the Open Studio on all large pieces of equipment to review the induction recommendations, if required to refresh your memory.
You must only use heavy weights on rubber flooring.
You must take reasonable care and consider your surroundings before performing exercises taking note of restrictions such as roof height, space around the equipment and stationary equipment.
You must not perform any movement which may cause damage to 101 Collins' or any other person's equipment, premises, or to yourself or other members in or around your surroundings.
You are required to return all RISE equipment to its correct location when you have finished using the relevant equipment (eg on returning weights and bars to the labelled racks).
Emergencies
If you require first aid, you must use the panic button to alert the security team for assistance. If the security team does not respond, the contact will be automatically directed to the emergency services at 000. You may cancel this call at any time.
In the event of an emergency, you must call 000.
If a hazard has been identified in the Open Studio, including (but not limited to) a slip or faulty equipment, you must notify and report this hazard to RISE immediately.
Personal belongings
You must use the provided lockers to store personal belongings. You agree that you will not leave your personal belongings or items which may be hazardous in the surrounding areas to other customers using the Open Studio.
RISE equipment
All RISE equipment belongs to 101 Collins or its nominee and remains at the RISE premises. Any RISE items that is removed from the premises without authorisation will be considered as theft and managed accordingly.
RISK
You understand that the Open Studio is not supervised. You acknowledge that you will receive no supervision whilst using the Open Studio and you use the premises at your own risk.
You have been instructed how to receive first aid support if required. You acknowledge that you are aware that the first aid responders are located on-site in the control room.
You acknowledge that in an emergency event, there may be no one available to respond in a timely manner. You acknowledge that there is a risk of not receiving immediate professional care which may result in the following (but not limited to):
permanent damage;
death;
enhanced risks of heart attacks and strokes;
head injuries; and
other serious or minor medical conditions, due to the delay in treatment.
You acknowledge there is an increased risk of the spread of infectious diseases due to unsupervised cleaning.
You acknowledge that whilst 101 Collins has on-site security, there is still a risk of an unauthorised person entering the RISE studio.
MISCELLANEOUS
You acknowledge that cameras are installed at the Open Studio and 101 Collins' premises and you may be monitored whilst attending the Open Studio. You acknowledge that security footage captured by those cameras will be collected and used in accordance with our privacy policy and the privacy collection notice set out in section 4. 101 Collins will retain security footage for a reasonable period in order to comply with its obligations under the Privacy Act 1988 (Cth).
You understand that you may be photographed or filmed during a studio class for promotional and advertising purposes, where a separate consent form has been given. Personal information collected for these purposes will be used in accordance with our privacy policy and the separate consent form given by you.
If a RISE representative believes you have not followed the guidelines for use of the Open Studio, your access may be suspended or revoked.
Acts of misconduct or failure to follow the terms of use may result in financial consequences.
You understand that you may be required to pay for loss or damage caused by your acts or omissions, misconduct or a failure to follow these terms of use.
PRIVACY COLLECTION NOTICE
101 Collins is committed to ensuring all personal information is held in a confidential and secure matter, in accordance with the Privacy Act 1988 (Cth), and our privacy policy. Our privacy policy is available on request, or on our website at /privacy-policy.
We collect personal information provided by you as set out in our privacy policy. We also collect your personal information in the form of images of you from footage captured by our security cameras as set out above,[for the purposes of minimising and detecting unlawful activity, preventing disturbances and assisting law enforcement and our security contractors in carrying out their responsibilities, and other purposes as set out in our privacy policy.
Your information may also be used or disclosed for those purposes, and for reasonable secondary purposes, where that purpose is related (or for sensitive information, directly related) to the primary purpose, or where permitted by the Privacy Act.
If we do not collect this information, we may not be able to provide you with the services you have requested or ensure the security of our facilities. Our privacy policy sets out further details about our usual disclosures of personal information, how you may contact us to make a complaint about our handling of your personal information, or to access or correct the personal information we hold about you.
GLOSSARY
The following defined terms are used in these terms of use:
RISE Representative means any officers, directors, employees, contractors, agents, or other representatives of 101 Collins or its nominee, and includes any third party consultants that 101 Collins permits to use the Wellness Centre to provide classes or services.
RISE Terms and conditions means the document dated 30 August 2022 which sets out the terms and conditions which apply to your RISE membership with 101 Collins. This terms of use apply in addition to the RISE Terms and conditions. A copy is available here.
Swipe card means the card issued to you by your employer.
Terms of use means this document, between 101 Collins and you, under which you are a RISE member.
